These General Terms and Conditions of Contracting govern the distance selling relationship between CIRCUS MACHINE SL and the user or customer, in accordance with the applicable legal provisions, especially Law 7/1998, of April 13, on General Terms and Conditions of Contracting, Law 3/2014, of March 27, which modifies the consolidated text of the General Law for the Defense of Consumers and Users, Organic Law 3/2018, of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights, the General Data Protection Regulation (EU) 2016/679, Law 7/1996, of January 15, on the Organization of Retail Trade, and Law 34/2002, of July 11, on Information Society Services and Electronic Commerce.
CIRCUS MACHINE SL reserves the right to make any modifications it deems appropriate to these General Terms and Conditions without prior notice. Such modifications may be made through its websites or any other legally admissible form and will be mandatory as long as they are published on the website until they are validly modified by subsequent terms. However, CIRCUS MACHINE SL reserves the right to apply, in specific cases, certain Particular Conditions of Contracting with preference over these General Terms when deemed appropriate, notifying the user in advance.
The purpose of the website is the marketing of clothing and accessories.
The duration of the contract is tied to the delivery of the product, without prejudice to the right of withdrawal.
As a user or customer, you expressly declare that you know, understand, and accept the terms of use and these General Terms and Conditions of Contracting. You are responsible for treating your identity and password acquired during registration as a customer confidentially and responsibly, and you may not reveal them to other users. You can change the information registered on the website at any time in your customer area. In this same section, you will have access to a history of your orders. It is solely a section for consultation. However, certain procedures are allowed, such as deleting records that you no longer wish to view.

When you receive the product at the provided delivery address, an invoice or a copy of the order will also be included.

Offer and Validity
In the case of a product on sale, the price and validity of the offer, along with its basic characteristics, will always be indicated.
In compliance with current regulations, CIRCUS MACHINE SL provides information about all the items for sale, including their characteristics and prices. The products offered in our online store include a photograph and basic product characteristics, which are provided by the manufacturer. The color of the product, as it appears in the photograph, is not binding. The color of the product is identified in its characteristics.

Guarantees
All products offered on the website are covered by the guarantee of sale from the supplier. CIRCUS MACHINE SL offers after-sales service, which the customer can contact during the warranty period by emailing info@nude-project.com or at the points established by the supplier.

Prices
All products display the sale price in Euros, including Value Added Tax (VAT).
If any other tax is applicable, it will also be reflected (IGIC or IPSI).

Shipping and Transport Costs
NUDE PROJECT SL only ships with a charge of ____€ within Spain, ____€ in Europe, and ___€ for international destinations in shipping costs.
For orders over ___€, shipping will be free within Spain.

Payment Methods
You can pay for your order using any of the following methods, and you must indicate which one you choose during the purchase process:

  • VISA or MASTERCARD Credit Card
    All operations involving the transmission of personal or banking data are performed in a secure environment on a server using standard SSL (Secure Sockets Layer) technology. All information you send is encrypted for transmission over the Web.
    Additionally, your credit card data is entered directly on the bank’s website in the Virtual POS (Point of Sale Terminal) and is not stored or registered on any CIRCUS MACHINE SL server.
    When you pay, you are directly connected to the electronic payment platform of Redsys (https://sis.redsys.es/sis/realizarPago).

    Your credit card data is entered directly on the bank’s website, in the Virtual POS (Stripe), and is not stored or registered on any CIRCUS MACHINE SL server. When you pay, you will connect directly with the electronic payment platform of Stripe.

When paying with VISA or MASTERCARD, you will always be asked for the following information: the card number, the expiration date, and a Validation Code corresponding to the last three digits printed in italics on the back of your VISA or MASTERCARD. This provides an additional security guarantee for the transaction.
This payment method is only valid on the website.

When the amount of a purchase is fraudulently or improperly charged by using a payment card number, the cardholder may request the immediate cancellation of the charge. In such cases, refunds and adjustments will be made as soon as possible to both the supplier’s and the cardholder’s accounts.
However, if the purchase was indeed made by the cardholder and the request for a refund was not due to exercising the right of withdrawal, and therefore the cardholder has unjustifiably requested the cancellation of the charge, they will be obliged to compensate NUDE PROJECT SL for the damages caused by the cancellation.

Service Performance
The availability of products offered by CIRCUS MACHINE SL may vary depending on customer demand. Although CIRCUS MACHINE SL updates stock periodically, it is possible that the product requested by the customer is out of stock at that time. If it is not possible to supply the product due to lack of availability, CIRCUS MACHINE SL will notify the customer by email as soon as it becomes aware of this situation. In no case will the period to send this notification exceed a maximum of 30 days. CIRCUS MACHINE SL may offer two options: supply the customer with a product of similar characteristics or superior quality at the same price or, unless justified reasons can be provided, refund the amounts paid for the canceled order within the same period.

Returns
The customer must return or deliver the product directly to CIRCUS MACHINE SL through this link: _______ , and in any case, within a maximum period of thirty calendar days from the date of purchase. The return period will be considered fulfilled if the customer returns the product before the expiration of this period.
The customer will bear the cost of the return.

Payment Refund
The amounts paid by the customer will be refunded using the same payment method used by the customer unless otherwise agreed.
